Terms of Use
- MemoryPlaces is free to download. A paid annual subscription and a one-time lifetime purchase are optional and sold through Apple.
- Your photos are yours. MemoryPlaces only creates and updates albums in Apple Photos; it never deletes photos.
- Refunds and billing are handled by Apple. Purchases can be restored on any device signed in with the same Apple Account.
1. Agreement
These Terms of Use (“Terms”) are an agreement between you and Home M K Inc., Ontario, Canada (“MemoryPlaces,” “we,” “us”). By downloading or using the MemoryPlaces app (the “App”) or memoryplaces.app, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.
The App is distributed through Apple’s App Store, and Apple’s Licensed Application End User License Agreement (“Apple EULA”) also applies. Where these Terms are more specific to the App, they apply between you and us; the Apple EULA continues to apply to your relationship with Apple. Apple is a third-party beneficiary of these Terms and may enforce them against you.
2. What the App does
MemoryPlaces lets you pick a photo, choose a radius around the place it was taken, and create an album in Apple Photos containing the photos from your library taken within that radius. You can later open a saved place and tap Refresh to add newer photos; an album changes only when you refresh it. Results depend on the location metadata stored in your photos; photos without location data cannot be matched by place.
The App requires access to your photo library to work. It reads location metadata, creates albums, and adds photos to those albums. It never deletes photos. When you delete a saved place in the App, you choose whether to keep or also remove the album in Apple Photos; the photos themselves are never touched.
3. Licence
We grant you a personal, limited, non-exclusive, non-transferable licence to install and use the App on Apple devices that you own or control, as permitted by the App Store terms. You may not copy, modify, distribute, sell, or lease any part of the App; reverse engineer or attempt to extract its source code; or circumvent any purchase or feature-gating mechanism.
4. Free and paid features
The App is free to download. The free tier lets you create up to three place albums and refresh them as often as you like; each free album uses a fixed 1 km area. Two optional purchases unlock the full App — unlimited place albums, resizing the area around a place, and iCloud Sync:
- Basic Annual — an auto-renewing yearly subscription.
- Lifetime — a one-time purchase.
Current prices are shown in the App Store in your local currency; applicable taxes may be added. Prices may change for new purchases; a change never affects a lifetime purchase you have already made, and a subscription price change takes effect only as Apple’s rules allow, with notice to you.
A Lifetime purchase unlocks the App’s paid features for as long as the App is available on the App Store and supported by us. It is tied to the Apple Account that made the purchase and cannot be transferred to another Apple Account.
5. Subscriptions
- Payment is charged to your Apple Account when you confirm the purchase.
- The subscription renews automatically unless you cancel it at least 24 hours before the end of the current period. Your Apple Account is charged for renewal within the 24 hours before the current period ends.
- You can manage or cancel the subscription in Settings › [Your Name] › Subscriptions on iPhone or iPad, or in the App Store app › your account › Subscriptions on Mac. Cancelling takes effect at the end of the current period; you keep access until then.
- Deleting the App does not cancel a subscription.
6. Restore purchases
If you reinstall the App or use it on another device, sign in with the same Apple Account and use Settings › Restore Purchases in the App to restore your subscription or lifetime purchase at no charge.
7. Refunds
All purchases are made through Apple, and Apple handles refund requests under its own policies. To request a refund, use reportaproblem.apple.com or contact Apple Support. We are not able to issue refunds directly.
8. Your photos and content
Your photos and the albums in your library belong to you. We claim no rights in them. The App creates and updates albums inside Apple Photos on your device; it does not upload, store, or back up your photos. You are responsible for keeping your own backups of your photo library. MemoryPlaces is not a backup or storage service.
9. Acceptable use
You agree to use the App only for lawful purposes and in accordance with these Terms and the App Store terms. You must not use the App in a way that infringes anyone’s rights, interferes with the App or with Apple’s services, or attempts to bypass any purchase, licence, or usage limit.
10. Third-party services
The App depends on Apple platforms and services, including Apple Photos, the App Store, and (if applicable) iCloud. Those services are governed by Apple’s terms. Changes Apple makes to its platforms — for example to photo-library permissions or to how albums can be opened on macOS — may affect how the App works, and we may need time to adapt or may be unable to work around them.
11. Updates and availability
We may update, change, or discontinue features of the App, and may release updates that require a newer version of iOS, iPadOS, or macOS. We aim to keep the App available and supported, but we cannot guarantee availability indefinitely. If we discontinue the App, we will give reasonable notice where practical.
12. Disclaimer
The App is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement, to the extent permitted by law. In particular, place matching relies on the location metadata in your photos, which may be missing, imprecise, or inconsistent; we do not warrant that every relevant photo will be found or that every matched photo belongs to the place you intended.
13. Limitation of liability
To the maximum extent permitted by law, Home M K Inc. will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of data, arising out of or related to the App. Our total liability for any claim relating to the App is limited to the amount you paid us for the App in the twelve months before the claim arose, or USD 30 if you paid nothing. Some jurisdictions do not allow certain limitations; in that case these limits apply to the fullest extent the law permits.
14. Termination
You may stop using the App at any time by deleting it (this does not cancel a subscription; see section 5). We may suspend or terminate your licence if you materially breach these Terms. Sections 8, 12, 13, and 15 survive termination.
15. Governing law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there, without regard to conflict-of-law rules. Any dispute will be brought in the courts located in Ontario, Canada, and you consent to their jurisdiction. If you are a consumer, nothing in these Terms takes away rights that the mandatory consumer-protection law of your place of residence gives you.
16. Changes to these Terms
We may update these Terms from time to time. The current version is always posted at this address with its effective date. If a change is material, we will note it in the App’s release notes or on this page. Continued use of the App after a change takes effect means you accept the updated Terms.
